INTRODUCTION

Welcome to travel.tl. We appreciate you taking the time to read these Terms and Conditions (“Terms”).

These Terms are important as they, together with your booking confirmation email (“Booking Confirmation”), establish the legal terms on which Travel Services are made available to you through our Service. They also govern any interactions or communications you have with us through our Service.

Your use of our Service is subject to these Terms, and it is a condition of using our Service that you accept these Terms. To book a Travel Service, you must also accept these Terms. If you do not accept these Terms, please do not use our Service or book a Travel Service.

We may update these Terms at any time for various reasons, including to: (1) improve the Terms and make them clearer or easier to understand, (2) comply with legal, regulatory, and/or tax requirements, (3) reflect changes to our Service or how we run our business, or (4) address security-related concerns. You can see when we last updated these Terms by checking the “Effective Date” at the top of this document.

If we make changes that will materially impact your rights or obligations, we will provide you with reasonable advance notice of such changes, unless the changes are urgently required for security, legal, or tax reasons, in which case we will notify you as soon as possible.

Your continued use of our Service after any changes come into effect constitutes your acceptance of the updated Terms. If you do not accept the changes, please do not use our Service. Any existing bookings will continue to be governed by the Terms that applied when the booking was made.

DEFINITIONS

In these Terms:

we”, “us”, or “our” refers to Travel Timor-Leste Pty Ltd (ABN [INSERT ABN]), an Australian company with its registered office at [INSERT ADDRESS], which provides our Service.

Content” refers to all text, descriptions, reviews, photographs, images, videos, and other content submitted to our Service.

Service Provider” refers to the travel supplier making available the Travel Services to you through our Service, including but not limited to accommodation providers, tour operators, car hire companies, and dive providers.

our Service” refers to the provision of our website (travel.tl), apps, and online tools.

Travel Services” refers to the travel services made available to you by the relevant Service Provider(s) through our Service, such as accommodation, tours, car hire, diving experiences, or other activities.

you” refers to you, the person using our Service or making a booking.

1. RULES AND RESTRICTIONS

In addition to these Terms, other terms and conditions provided by Service Providers (such as an accommodation provider’s terms and conditions, a car hire company’s rental agreement, etc.) also apply to your booking (“Rules and Restrictions”).

To make a booking, you must accept the Rules and Restrictions of the Service Provider that you select (such as payment terms, cancellation policies, refundability, availability restrictions, and use of services, etc.). The relevant Rules and Restrictions are provided to you before you make a booking and are incorporated by reference into these Terms.

If you violate a Service Provider’s Rules and Restrictions, your booking may be cancelled, and you may be denied access to the relevant Travel Service. You may also lose any money paid for such booking, depending on the Service Provider’s Rules and Restrictions.

2. USING OUR SERVICE

2.1 Our Rules

We provide our Service to help you find information about Travel Services and to assist you in booking those Travel Services. It is provided to you for no other purpose.

You agree that:

  • You will only use our Service for personal and non-commercial purposes;
  • You must be at least 18 years of age and have the legal authority to enter into contracts;
  • You will use our Service lawfully and in compliance with these Terms;
  • All information supplied by you is true, accurate, current, and complete;
  • If you book on behalf of others:
    • You will obtain their authorization prior to acting on their behalf;
    • You will inform them about the terms that apply to the booking (including the Rules and Restrictions) and ensure that they agree to, and will comply with, such terms; and
    • You will be responsible for paying any amounts due, for making any change/cancellation requests, and for all other matters relating to the booking.

You also agree not to:

  • Make any false or fraudulent booking;
  • Access, monitor, or copy any content on our Service using any robot, spider, scraper, or other automated means or any manual process;
  • Violate the restrictions in any robot exclusion headers on our Service or bypass or circumvent other measures employed to prevent or limit access to our Service;
  • Take any action that imposes, or may impose, an unreasonable or large load on our infrastructure;
  • Deep link to any part of our Service;
  • “Frame”, “mirror”, or otherwise incorporate any part of our Service into any other website.

2.2 Access

We may deny anyone access to our Service at any time for any valid reason. We may also make improvements and changes to our Service at any time.

2.3 Account

To make use of all the features available on our Service, you may need to create an account with us and sign in to it.

To create an account, you must be at least 18 years of age and follow the account creation instructions provided through our Service.

If you have an account with us, you must:

  • Safeguard your account information;
  • Be responsible for any use of your account by you or others (even those transactions that you did not intend to be performed);
  • Notify us immediately of any unauthorized use of your account; and
  • Provide us with all necessary information, to the extent required for us to comply with our legal obligations.

For information on how to delete your account, sign into your account on our Service and follow the applicable account deletion process or contact our customer service.

2.4 How We Order Your Search Results

There are many travel options available through our Service, and we want to make your search results as relevant as possible. At the search results page, you will see our default sort order; however, you can select how to sort your results and use filter options to prioritize results based on your chosen preferences, for example, price, guest review score, or other criteria.

Within your search results, we may sometimes display travel options that are paid-for commercial listings from our Service Providers. Such travel options are clearly labeled for your information as “Sponsored” or similar equivalent labeling, to differentiate them from other travel options.

2.5 Compensation

When you make a booking with our Service (and such booking is completed), we will be entitled to receive compensation from the Service Provider for that completed booking. This compensation is typically in the form of a commission based on the value of the booking.

2.6 Redirection and Third-Party Booking Services

If you are redirected from our Service to a third-party booking service to make a travel booking, please bear in mind that any bookings made through such a booking service will be with the third party and not with us. We are not responsible for bookings made through third-party booking services, and we have no liability to you in respect of such a booking. The terms and conditions of the third-party service provider will set out what rights you have against them and will explain their liability to you.

3. CONFIRMING A BOOKING

Your Booking Confirmation includes the essential elements of your booking, such as the description of the Travel Service(s) booked and the price.

We will send your Booking Confirmation and any relevant travel documents to the email address you provide when you book. If you do not receive your Booking Confirmation within 24 hours of making your booking, please contact us.

4. PAYMENT

4.1 Price

The price of the Travel Service(s) will be as displayed on our Service, except in cases of obvious error.

Prices for Travel Services are dynamic and can change at any time. Price changes will not affect bookings already accepted, except in cases of obvious error. We display many Travel Services, and we try hard to ensure that the displayed price is accurate. We reserve the right to correct any pricing errors on our Service.

If there is an obvious error and you have made a booking, we will offer you the opportunity to keep your booking by paying the correct price, or we will cancel your booking without penalty. We have no obligation to make available Travel Services to you at an incorrect (lower) price even after you have been sent a Booking Confirmation, if the error should reasonably have been apparent to you.

4.2 Price Match Guarantee

For customers introduced via our website, we offer a Price Match Guarantee. If you find a lower price for the same Travel Service (same dates, same provider, same conditions) on another website within 24 hours of making a booking through our Service, we will match that price. To claim this guarantee, you must:

  • Contact us within 24 hours of making your booking;
  • Provide evidence of the lower price, including a screenshot or link to the other website;
  • Ensure the lower price is for an identical Travel Service (same dates, same provider, same conditions);
  • Ensure the lower price is publicly available and can be booked by the general public (not a special offer, membership rate, or part of a package).

The Price Match Guarantee does not apply to prices on Service Providers’ own websites or to prices that include errors, special offers, loyalty program rates, or rates that require membership.

4.3 Taxes

The prices displayed through our Service may include taxes or tax recovery charges. Such taxes or tax recovery charges may include amounts associated with goods and services tax (GST), sales tax, occupancy tax, and other taxes of a similar nature.

In certain jurisdictions, you may be responsible for paying local taxes imposed by local tax authorities (such as city taxes or tourist taxes, etc.). Our Service Provider may charge you such local taxes. We will notify you of any local taxes that will be payable by you before you complete your booking, where such taxes have been notified to us by the Service Provider.

The amount of local taxes can change between the booking date and stay date. If taxes have changed by your stay date, you may be liable to pay taxes at the higher rate.

4.4 Payment Processing

When payment is due to be taken at the time of your booking and paid for in Australian Dollars (AUD), the company taking that payment (via third-party payment processors) and charging your payment method will be Travel Timor-Leste Pty Ltd.

Our Privacy Statement provides information on how we use your payment and account information when you elect for us to store a credit or debit card or other payment method for future use.

4.5 Payment Verification

You authorize us or the Service Provider to:

  • Verify your payment method by obtaining a pre-authorization, charging a nominal fee, or through other verification means; and
  • On verification, charge your payment method.

4.6 Fees Charged by Banks

Some banks and card issuers impose fees for international or cross-border transactions. For example, if you make a booking using a card issued in a different country from the Service Provider’s location, your card issuer may charge you an international or cross-border transaction fee.

Also, some banks and card issuers impose fees for currency conversion. For example, if you make a booking in a currency different from the currency of your credit card, your card issuer may convert the booking amount to the currency of your credit card and charge you a conversion fee.

If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or card issuer. We are not associated with or responsible for any fees relating to varying exchange rates and card issuer fees.

4.7 Currency Conversion

Any currency conversion rates displayed on our Service are based on public sources and current exchange rates, which may vary between the time a booking is made and the time of travel. Such rates are provided for information purposes only, and we do not guarantee the accuracy of such conversion rates.

5. CANCELLATIONS AND CHANGES

5.1 Cancellation by You

Cancellation of any booking is subject to the cancellation policy of the relevant Service Provider as specified in their Rules and Restrictions. If you cancel a booking, you may be entitled to a partial refund according to the Service Provider’s cancellation policy.

All Travel Services booked through our Service are subject to the following minimum cancellation periods, unless the Service Provider’s cancellation policy specifies a longer period:

  • Accommodation: 48 hours before check-in date
  • Car Hire: 24 hours before pick-up time
  • Tours and Activities: 72 hours before the scheduled start time
  • Diving Experiences: 72 hours before the scheduled start time

Cancellations made after these minimum periods may result in no refund being provided.

5.2 Cancellation by Us or the Service Provider

We and the Service Provider reserve the right to cancel your booking in the following circumstances:

  • In case of force majeure or other circumstances beyond our control;
  • If you have not paid the full amount by the payment due date;
  • If we have reasonable grounds to believe that your booking is fraudulent or made for an illegal purpose;
  • If we have reasonable grounds to believe that you have violated or will violate these Terms or the Service Provider’s Rules and Restrictions.

In the event of such cancellation, we will notify you as soon as possible, and you may be entitled to a refund depending on the circumstances of the cancellation.

5.3 Refund Policy

Refunds are processed according to the Service Provider’s refund policy as specified in their Rules and Restrictions. However, travel.tl reserves the right, at its sole discretion, to issue refunds in exceptional circumstances, even if the Service Provider’s policy would not normally allow for a refund.

Refund requests must be submitted to us in writing, stating the booking reference number and the reason for the refund request.

If a refund is approved, it will be processed to the original payment method used for the booking. Refunds may take up to 30 days to be processed, depending on your payment provider.

5.4 Changes to Bookings

Changes to bookings (such as dates, times, or services) are subject to the change policy of the relevant Service Provider as specified in their Rules and Restrictions. Changes may incur additional fees or charges, and in some cases, changes may not be possible.

To request a change to your booking, please contact us with your booking reference number and details of the requested change.

6. INTELLECTUAL PROPERTY

6.1 Our Intellectual Property

All intellectual property rights in our Service and its Content, including but not limited to text, graphics, software, photographs, and other images, videos, sound, trademarks, and logos, are owned by us or our licensors. Nothing in these Terms gives you any rights in respect of any intellectual property owned by us or our licensors, and you acknowledge that you do not acquire any ownership rights by downloading, printing, or using the Content.

You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify any Content in any way, including for public or commercial purposes, without our prior written consent.

6.2 Your Content

By submitting reviews, comments, or other content to our Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or otherwise control all of the rights to the content that you submit; that the content is accurate; that use of the content you supply does not violate these Terms and will not cause injury to any person or entity; and that you will indemnify us for all claims resulting from content you supply.

We have the right, but not the obligation, to monitor and edit or remove any content submitted to our Service. We take no responsibility and assume no liability for any content submitted by you or any third party.

7. LIABILITY

7.1 Our Role

We act as an intermediary between you and the Service Providers. We are not the provider of the Travel Services, and we have no liability regarding the provision of those Travel Services. The Service Provider is solely responsible for the Travel Service they provide to you.

7.2 Limitation of Liability

To the maximum extent permitted by law, we will not be liable for:

  • Any indirect, special, incidental, exemplary, or consequential loss or damage of any kind arising from your use of our Service or any Travel Service;
  • Any loss of profit, loss of business, business interruption, or loss of business opportunity;
  • Any loss or damage arising from information, software, or other material obtained through our Service;
  • Any loss or damage arising from unauthorized access to data or information transmitted over the internet;
  • Any failure or delay in providing our Service due to events outside our reasonable control.

Our total liability to you for all losses, damages, and causes of action will not exceed the amount paid by you, if any, for accessing our Service or booking the relevant Travel Service.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Australian law.

7.3 Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our Service or your violation of these Terms.

8. GENERAL

8.1 Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Australia. You and we both agree to submit to the non-exclusive jurisdiction of the Australian courts.

8.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

8.3 Entire Agreement

These Terms constitute the entire agreement between you and us regarding our Service and supersede and replace any prior agreements we might have had between us regarding our Service.

8.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

8.5 Commission Program

Service Providers operating on travel.tl work on a commission charge program for all their listings on the site. Commission is payable upon delivery of the Travel Service and subsequent payment clearance, which occurs 5 days post-fulfilment. The specific commission rates are outlined in the separate Partnership Agreement between travel.tl and the Service Provider.
